These terms and conditions are agreed in part by RED-MOTION company with a capital of 55 716 euros whose registered office is at 6, rue Léonard de Vinci - 53001 LAVAL CEDEX FRANCE, registered with the Trade and Companies of LAVAL under number 521 429 431 hereinafter referred to as "RED-MOTION" and secondly, by any person or entity wishing to make a purchase via RED-MOTION website hereinafter referred to as "the buyer".
1. Object
1.1 These conditions of sale define the contractual relationship between RED-MOTION and the buyer (professional or individual) and conditions applicable to all purchases made through RED-MOTION Website
1.2 The acquisition of a product through this site implies a general acceptance by the buyer of these conditions of sale.
1.3 These conditions of sale prevail over any other general or special conditions not specifically approved by RED-MOTION.
1.4 RED-MOTION reserves the right to modify terms and conditions at any time. In this case, the conditions will be those effective on the date of the buyer order.
2. Characteristics of the products offered
2.1 Products sold are those listed in the catalog published on the site.
2.2 These products are sold in the limit of available stocks.
2.3 Each product is accompanied by a description provided by RED-MOTION.
2.4 Photographs of catalog are as accurate as possible but can not ensure a perfect similarity with the product, especially regarding colors.
3. Prices
3.1 The prices listed in the catalog are in Euro including French VAT for particular buyer whose address is in the EU area. For a professional buyer or a buyer whose address is outside EU, prices are in euros tax excl.
3.2 RED-MOTION reserves the right to change prices at any time.
3.3 Prices do not include order processing, transportation and delivery.
4. Geographical area
Online sale of products presented on the site is for only possible for buyers whose country is present in the drop down list for the buyer's address.
5. Orders
5.1 The buyer, who wishes to buy a product must:
– complete the identification sheet which show all the data requested;
– validate the order after reviewing it;
– make payments under the conditions laid;
5.2 The validation of the order by making its payment implies acceptance of these terms of sale, the recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions.

5.4 RED-MOTION will email confirmation of the order recorded.
6. Retraction
The buyers, non-professional individuals, have a withdrawal period of thirty days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.
7. Payment terms
7.1 Payment is due with order. It can be by credit card, check or bank transfer.
7.2 Payments by credit card are made through the secure system « Paypal » which uses SSL protocol (Secure Socket Layer) such that transmitted information is encrypted by a software and no third party can read it over the network.
7.3 The paper invoice will be sent only upon buyer request.
8. Delivery
8.1 Deliveries are made to the delivery address specified by the buyer.
8.2 Risks are borne by the buyer from the moment when products have left RED-MOTION office. In case of damage during transportation, complaint must be made to the carrier within three days from delivery.
8.3 Delivery times are only given as an indication; if they exceed thirty days from the order, the sale may be canceled and the buyer refunded.
9. Warranty
9.1 All products supplied by the seller have the legal guarantee provided by Article 1641 of the French Civil Code.
9.2 In case of non-compliance of a product sold, it can be returned to RED-MOTION who will take over, refund or exchange.
9.3 All claims, requests for exchange or refund must be made by the following email address: info@baramind-bike.com within thirty days from delivery.
10. Responsibility
RED-MOTION, in the online sales process is only bound by an obligation of means; his responsibility can not be incurred for damages resulting from the use of Internet such as data loss, intrusion, viruses, break service, or other unintended problems.
11. Personal data
11.1 In accordance with French law on computers, files and freedoms of 6 January 1978, the name information of buyers may be subject to automated processing.
11.2 RED-MOTION reserves the right to collect information on purchasers including by using cookies, and, if desired, to transmit to business partners the information collected.
11.3 Buyers can oppose disclosure of their details by notifying RED-MOTION. Also users have a right to access and correct data concerning them, according to the French law of 6 January 1978.
12. Filing - Proof
12.1 RED-MOTION archive purchase orders and invoices on a reliable and durable spport constituting a faithful copy in accordance with article 1348 of the French Civil Code.
12.2 The computerized records of RED-MOTION will be regarded by the parties as proof of communications, orders, payments and transactions between the parties.
13. Litigation
13.1 These online terms of sale are subject to French law.
13.2 In case of dispute, jurisdiction is given to the competent tribunals of LAVAL.
